The Role of Paralegals in the Legal System Essay -- Legal Assistant

Justice. It is something that everyone wants, something that we strive for, even something that sparks. However, when we think of lawyers, we think of superheroes with an expensive education, walking into the courtroom and serving up justice. What no one thinks of is the person that helped the lawyer get there, the paralegal that prepares the necessary documents, the paralegal that makes sure his or her attorney is at the right place at the right time. A paralegal is crucial and in some cases vital to our justice system yet they are so often over looked. To understand what a paralegal does we must first understand what the job of a lawyer entails. Black’s Law Dictionary defines a lawyer as â€Å"a person learned in the law; as an attorney, counsel or solicitor; a person who is practicing law.† Attorneys generally have around seven years of a college education under their belt, they have the authority to argue their clients case before a judge and jury. Just because a person has a law degree does not necessarily mean that they are skilled lawyers. One could have the best education money can buy but still be a lousy attorney. Practice and careful preparation is needed before one goes to court, but there is still one thing that is invaluable to an attorney. Experience. All of the classes in the world could not prepare one for the nerve that it takes to stand before a judge and jury with your client beside you trusting you to put up a fight. I had the opportunity to witness the behind the scenes action as a young attorney recently prepared for his first trial. What I saw is not what would normally happen but it is something that does happen. This attorney was given about three hours to prepare for his first trial, he had about three ye... ... by a lawyer, law office, corporation, governmental agency or other entity who performs specifically delegated substantive legal work for which a lawyer is responsible." Health promotion Primary, secondary and tietary Essay

Heath promotion connotes the activity of empowering individuals to have influence over their well-being. As described in the journal Health promotion: Conceptual and ethical issues, the promotion entails enabling people to make decisions on their own in situations where their decisions could impact positively on their overall health. A similar description is used in the article, Improving Health Promotion and Disease Prevention in NP-Delivered Primary Care, however, the author places much emphasis on the need for consensus among professionals prior to entrusting individuals the right to influence a doctor’s decisions. To some extent, Dawson and Grill (2012) echoes similar sentiments, but the authors consider the term an oxymoron. The two also explores the controversies surrounding the definition of the term while focusing on the cultural implication of the implementation the holistic approach to treatments. Thomas, Hart, and Burman (2014, p. 222), strikes out because it explores the need for corporation among stakeholders in ensuring the attainments of the goal of providing the populace with quality care at a lower costs. Despite the differences, both the definitions explain health promotion similarly. The main purpose of health promotion is enhancing coordination in order to limit the possibilities of the use a wrong approach to treatment. The other intention is to use preventions as opposed to cure since the latter costs much. Apart from reducing costs, the techniques reduces the number of visits to medical facilities in situations where home-based care can be used in treatment of ailments. The concept is also improving quality by encouraging practitioners to evolve in health promotion by educating the patients on each level such as primary, secondary and tertiary. This implementation is also becoming popular with nursing because it advocates for the  customization of treatment to s uit the need of the sick. The idea is to incorporate more than one approach to treatment as highlighted by Ipsen, Ruggiero, Rigles, Campbell & Arnold (2014, p. 125). In the article, Evaluation of an online health promotion program for vocational rehabilitation consumers, the author elaborates the need for mutual coordination by citing examples of success following the adoption of the strategy in the dissemination of information to people suffering from cardiovascular diseases. The concept of health promotion is responsible for changes in the healthcare professions with the recent change being the case of nurses becoming more considerate in their actions due to the evolving natures of the practices. Nurses no longer base their decision on their judgment, but they consult with patients prior to making decisions as stipulated in the law. They are more of consultant than clinicians as illustrated by Thomas, Hart, and Burman (2014, p. 224). In addition to showing concern to the needs of the sick, nurses are taking nontraditional duties that entail empowering patients to use their knowledge in helping their counterparts who might be suffering from the same condition as theirs. Moreover, the demand for value based service is on the rise as a result of the adoption of the inclusive approach to treatment. Conducting initiatives and making follow ups on the progress of patients is a techniques which encompasses all the task of nursing that include preventing, consulting, and offering care. The technique of prioritizing needs based on patient’s demand is also an implementation method since it facilitates treatment of chronic ailments while at the same time encouraging follow-ups by nurses. Engaging in consolations with community members as health promotion strategy is also commendable because the method covers all the areas of the professions that includes assessing the situation, planning for the implementation of a solution and monitoring the effectiveness of the program. Adhering to health promotion guidelines also teaches one to become a responsible practitioner who has the capacity to detect anomaly in a situation at an earlier stage. The first level which is the primary levels applies to all situations particularly in cases involving the spread of contagious diseases. The level requires professionalism since the home based approach might fail due to lack of understanding by the people. As highlighted in a study of pediatricians in Ottawa, the attitude of the nurses played a  critical role in the healing of patients. Therefore, it can be said that the success of the primary levels is dependent on the implementation of health promotion strategies from a holistic perspective. The second level secondary is the intermediary level described in three articles as the correction stage can be useful in controlling the extent of the damage in situations where the ailments has been detected . On numerous occasions, the chances of failure in the elimination of an infection is possible at this stage. Dawson and Grill (2012, p. 102) describes it as the screening stage in which accuracy in detection of ailment is paramount in controlling further infections. The third level tertiary employs similar techniques like the first and the second, but with much caution to prevent the sick from dying. In particular, the focus is on the person who has already contracted an ailment. Sometimes the combination of more than one approach to preventing disease happens at this stage. In conclusion, despite the challenges of integrating various approaches of treatment, nurses continue to provide health promotion at the primary, secondary and tertiary levels. Life of a Corrections Officer Essay

Being a correction officer is not an easy job. Each and every correction officer has a daily routine, stress, danger, and has to learn to gain compliance of every inmate. Every day in a prison working with inmates can be a challenge; some days may seem easier than other days. There is a daily routine and schedule that each correction officer has to come to terms with. The tasks could be working in the yard to supervising inmates on the work crew. The jobs vary with each officer. But no matter which job, each one is or can be very stressful when it comes to maintaining and keeping inmates in order. Each job can be very stressful, but it is up to the correction officer to take disciplinary actions in a mannerly way. A correction officer has a job everyday to â€Å"maintain control and order within a prison† (Seiter, 2011, p.390). Every day each inmate has to be under supervision at all times and each correction officer makes sure that security is maintained properly. Each and every correction officer has an assigned job they have to perform. There are usually seven categories’ that a correction officer can be assigned to. These categories include living units, work detail supervisors, industrial shop and school officers, yard officers, administration building assignments, perimeter security and relief officers. â€Å"Each Specific assignment has post orders, a detailed description of the activities that are required to be performed throughout the day, often includes the time they are to occur†(Seiter,2011,p.391). Post orders is to tell the correction officer how to do each specific assignment. Each assignment that is performed has a time schedule. The correction officer also has to report a detailed report on the assignment. Every minute, of every day while the correction officer is on duty, it very crucial. For instance, one minute an officer may be walking inmates to their cells and then the next minute, they could be breaking up a fight. The main part of being a correction officer is to never show any signs of weakness to any inmates. If any signs of weakness are shown, the inmates can and will use that against the officer and try everything to bring that officer down. With an inmate using an officers weakness against them, can cause a lot of stress and danger to the correction officer. Stress is very typical with being a correction officer. Stress can come from overtime shifts, not enough employees on hand, violence in the facility, or problems with other staff members. Many programs are available to help correction officers to deal with stress because stress will always be a part of being a correction officer. â€Å"Job stress has been found to have numerous negative mental and physical effects on correctional staff. Cheek and Miller (1983) reported that correctional officers have a higher than expected likelihood of hypertension, heart attacks, and other stress-related illnesses. Ultimately, the health of the correctional employee can suffer to the point that it shortens the person’s life. Both Cheek (1984) and Woodruff (1993) reported that correctional officers die far sooner than expected as compared to the national life expectancy, and stress is the leading reason for the shortened life expectancy†(Lambert, 2006). Stress is not good for a person’s health and that is why these facilities offer options to deal with stress while working in such facilities. These trainings help the correction officer to help avoid the stressful situations and how to deal with their own personal stress. Counseling is offered for the correction officers and the families. This helps them to deal with stress and keep the levels of stress down. The best way to help keep stress down is keeping a healthy active life, such as diets, exercise, and trying to maintain financial security. All though, stress seems to be an important role with being a correction officer, it’s not. The most important is gaining compliance from inmates. This means that a correction officer needs to deal with inmates without threatening them or disciplining an inmate without their being a breakout in the prison or the inmate rebelling against any orders that are given.† It is not easy to gain compliance from inmates already in prison, many of whom rebel against all authority and are serving long sentences with very little to lose†(Seiter,2011,p.394). If any inmates do not follow any orders, the correction officer has the power to punish them in the appropriate way. The most important skill to use is interpersonal communication. This communication allows correction officers to treat inmates humanly as possible. If a correction officer treats an inmate with disrespect, it is most likely that the inmate will get very angry and rebel against that officer. Inmates do not like to be treated unfairly, as they should not be treated unfair in any given circumstance. Every inmate has the knowledge of knowing they should follow rules and what they should and should not do. It can be very stressful being a correction officer. The main key is to have training to deal with stress and know what kind of stress they may be in for. Stress can come from many different directions and effect a correction officer, but as long as they know what they were getting into before they got into the situation, then they should be able to deal with the stress pretty good. As long as a correction officer can be fair and treat inmates fairly, then that can also help reduce stress and make the situations in the facility go a lot smoother. Due to this dream, it was believed that America was the land of opportunity, wealth, and prosperity. The dream consists of three components: all men are equal, man can trust and should help his fellow man, and the good, virtuous and hard working are rewarded. F. Scott Fitzgeralds novel The Great Gatsby is a condemnation of American Society and focuses on its downfall. This holds true for three of the main characters in the novel, Jay Gatsby, Tom Buchanan, and Daisy Buchanan. To reach his ideal dream of spending his life with Daisy, Jay Gatsby attains his millions in a corrupt way which help him to replace emotions, and tries to cover it up with lies throughout the novel. In order to become rich, Gatsby engaged in illegal occupations such as bootlegging and being involved in the Mafia. He and this Wolfsheim bought and sold grain alcohol over the counter. (Fitzgerald 134). This is the opposite idea of the American Dream, which states that only the good, virtuous and hard working are rewarded. Gatsby also lies his way through life to conceal his wrongdoing. Gatsby claims that he belongs to a rich family whom provides his way to Oxford and from whom he inherits his riches. I am the son of some wealthy people in the Middle West-all dead now. (Fitzgerald 65). Only later on in the novel, does Nick uncover the truth that his parents were shiftless and unsuccessful farm people... (Fitzgerald 99). Gatsby also relies on money to bring him the comfort of family. G atsbys musicians sing, The rich get richer and the poor get-children. (Fitzgerald 96). It’s a hobby of mine to go around hyphenating word groupings that are modifying unbeknownst to them. Once you learn what it’s all about, you’ll do the same. But, what is a compound modifier, you ask. Well, let me tell you†¦ The rule Which would you rather read? She looked up at the green sky and shrunk away from the white lightning or She looked up at the eerie-green sky and shrunk away from the white-hot lightning. A compound modifier refers to two or more words expressing a single concept. Regular adjectives modify nouns all the time, but a compound modifier goes much further. His yellow-green teeth were visible beneath a salt-and-pepper mustache. The words yellow and green, and salt and pepper are adjectives modifying the nouns teeth and mustache. Since they appear before the noun, they are hyphenated. If they followed the noun, they would no longer be hyphenated. From underneath his mustache, which looked like salt and pepper, you could see his teeth of yellow and green. Exceptions The only time the compound modifier is not hyphenated ahead of the noun is if the word very or an adverb ending in ly is used. For instance: The very dark sky hovered over us versus The raven-black sky hovered over us. Sometimes the compound modifier does keep the hyphenation after the noun – when it follows a form of the verb to be. For example: The soup was water-thin, but delicious all the same. More examples The shelves were buckling under the weight of dust-covered books. Books covered in dust filled the buckling shelves. Books, which were dust-covered, filled the sprawling shelves. We followed the man through a poorly lit corridor. The room we entered was well-lit. We entered a well-lit room. We followed him into a room, well lit with candles and a fire. The Session_Start() Function in PHP In PHP,  information designated for use across several web pages can be stored in a session. A session is similar to a cookie, but the information contained in the session is not stored on the visitors computer. A key to open the session- but not the information contained within- is stored on a visitors computer. When that visitor next logs in, the key opens the session.  Then when a session is opened on another page, it scans the computer for the key. If there is a match, it accesses that session, if not it starts a new session. With sessions, you can build customized applications and increase the usefulness of the site to its visitors.   Every page that will use the session information on the website must  be identified by the session_start() function. This initiates a session on each PHP page. The session_start function must be the first thing sent to the browser or it wont work properly. It must precede any HTML tags. Usually, the best place to  position it is right after the ?php tag. It must be on every page you intend to use. The variables contained in the session- such as username and favorite color- are set with $_SESSION, a global variable.  In this example, the session_start function is positioned after a non-printing comment but before any HTML. In the example, after viewing page 1.php, the next page, which is page 2.php, contains the session data and so on. The session variables end  when the user closes the browser. Modifying and Deleting a Session To modify a variable in a session, just overwrite it. To remove all the global variables and delete the session, use the session_unset() and session_destroy() functions. Global vs. Local Variable A global variable is visible throughout the program and it can be used by any function in the program. A local variable is declared inside a function and that is the only place it can be used.

The acceptance of Genetic Therapy in the American society - Essay Example The manipulations of the creative chemical of life, DNA, inspires both wonder and fear in the human heart and mind and has created countless controversies in its application to combat disease. Genetic therapy is the alteration, removal, or insertion of genes in order to treat an illness. This definition is taken from the Washington Times article by, Marilynn, Marchione. This method uses a technique discovered by researchers to find and then correct the defective genes that are cause of the disease. This scientific marvel raised many questions, both in the scientific community and the public, each having various interpretations and viewpoints on the subject of genetic therapy. Some people depend on these experiments to improve their lives while others deem scientists as playing God. On the other hand some can see both side of the spectrum. Introduction (Positive) Those people suffering from a disease most often will have a positive and optimistic outlook regarding the promising resear ch involving genetic therapy. Curing a life threatening disease like AIDS, or repairing vision loss that severely impacts your quality of life can bring about an new and hopeful world for those who are suffering. This would be a world where one would not have to worry about suffering or even their longevity; they could just live carefree. This may seem like a pipe- dream, but the good news is that every day we are coming close to making it a reality. This remarkable new therapy was brought to light from and the case of an AIDS patient who seemed to recover from the disease after receiving a blood transfusion from a donor, who apparently had a natural immunity to HIV. Therefore it was theorized that the donor cells combated the virus. Regarding article reporting this same case, during a Boston conference Dr. John Zaia, was quoted after the announcement of their scientific breakthrough saying. â€Å"For the first time, people are beginning to think about a cure†. This was uplif ting news for the entire world because many people had died from AIDS. Thinking that a virus that killed millions can one day be treated as if it were a common cold truly shows the advancement and growth science and medicine This article further states, â€Å"Scientist used genetic engineering in six patients to develop blood cells that are resistant to HIV.† However, even though the gene therapy has shown very promising results, one must not celebrate too soon as this research is still in experimental stages, and it is still far too early to declare this method as an absolute cure. Gene therapy offers various possilbe benefits, and discovering a cure for HIV is perhaps only the beginning. For the first time in history researchers are using this new therapy to improve the vision in patients who were almost blind. According to The Seattle Times writer, Thomas H. Maugh, â€Å"this discovery brings hope to thousands with inherited forms of vision impairment in the field of reti nal dystrophies.† Previously, cataract surgery along with medication and corrective lenses were used to cure vision impairment. Additionally, doctors have not been able to restore vision due to hereditary degenerative disease to restore their patients sight. Now with the use of gene therapy scientists are able to take these defective genes and replace them with strong healthy ones in order to cure an ailment.
